These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Jubilee ("Jubilee," "we," "us," or "our") regarding your use of our automated bi-weekly mortgage payment service and related platform.
Please read these Terms carefully. By creating an account, accessing our website, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Important: These Terms include an arbitration clause and class action waiver in Section 13. By agreeing to these Terms, you agree to resolve disputes through binding arbitration rather than in court.

By accessing or using Jubilee's services, you agree to:

Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Updating the "Last Updated" date at the top of this page
- Sending an email to your registered email address
- Displaying a prominent notice in your dashboard
Your continued use of Jubilee after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using our services and close your account.

Certain features of our service may be subject to additional terms and conditions, which will be presented to you at the time you access those features. Those additional terms are incorporated into these Terms by reference.

Eligibility
Age Requirements
You must be at least 18 years old to use Jubilee. By using our service, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding contract
- You are not prohibited from using our services under applicable law
Geographic Restrictions
Jubilee is currently available only to residents of the United States. You may not use our services if:
- You are located outside the United States
- Your use would violate any law in your jurisdiction
- You are on any U.S. government list of prohibited or restricted parties
Mortgage Requirements
To use Jubilee's bi-weekly payment service, you must:
- Have an active mortgage with a recognized U.S. lender
- Be current on your mortgage payments
- Have the legal authority to make payments on the mortgage
- Have a U.S. bank account in good standing
Important: Jubilee is not a lender and does not provide mortgage loans. We are a payment facilitation service only.

Account Registration and Security
Account Creation
To use Jubilee, you must create an account by providing:
- Your full legal name
- A valid email address
- A secure password
- Your mortgage information
- Your bank account details (via Plaid)
- Any other information requested during registration
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Using a strong, unique password
- Logging out after each session
Account Accuracy
You agree to:
- Provide accurate, current, and complete information
- Update your information promptly when it changes
- Notify us of any changes to your mortgage or banking information
- Verify all payment amounts and schedules are correct
Account Security Best Practices
- Use a unique password not used on other websites
- Enable two-factor authentication when available
- Never share your login credentials with anyone
- Review your account activity regularly
- Report suspicious activity immediately
Account Suspension
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- We detect fraudulent or suspicious activity
- Your payment method fails or is declined
- We are required to do so by law
- We reasonably believe your account poses a security risk

Service Description
What Jubilee Does
Jubilee provides an automated bi-weekly mortgage payment service that:
- Calculates your bi-weekly payment amount (half of your monthly payment)
- Automatically debits your bank account every two weeks
- Forwards payments to your mortgage lender or servicer
- Tracks your payment history and savings
- Provides amortization schedules and financial insights
- Sends payment confirmations and reminders
What Jubilee Does Not Do
Jubilee is not:
- A mortgage lender or loan servicer
- A financial advisor or investment advisor
- A credit counseling or debt consolidation service
- A bank or financial institution
- A guarantor of any savings or financial outcomes

Service Availability

Payment Processing
Payments are processed through our third-party partners (Melio, Stripe, Plaid). We are not responsible for:
- Delays caused by banks or payment processors
- Errors in bank account information you provide
- Your lender's application of payments
- Bank holidays or processing delays
- Insufficient funds in your account

Payment Terms and Billing
Subscription Fees
Jubilee charges a monthly subscription fee for our services:
- Standard Rate: $9.00 per month
- Founding Member Rate: $4.50 per month (for eligible early adopters)
- Fees are billed monthly in advance
- All fees are in U.S. Dollars
Founding Member Pricing
Founding members who join before our official launch are eligible for lifetime 50% discount:
- Founding member pricing is locked in for life
- Rate will never increase as long as you maintain active subscription
- If you cancel and later resubscribe, standard rates apply
- Founding member status is non-transferable
Payment Authorization
By subscribing to Jubilee, you authorize us to:
- Charge your payment method for monthly subscription fees
- Debit your bank account for bi-weekly mortgage payments
- Automatically renew your subscription each month
- Update your payment method using information from your card issuer
Failed Payments
If a subscription payment fails:
- We will attempt to process the payment again
- We may suspend your service until payment is received
- You remain responsible for all outstanding fees
- We may charge a failed payment fee as permitted by law
Refund Policy
Our refund policy is as follows:
- First Month: Full refund available within 30 days of first payment
- After First Month: No refunds for monthly subscription fees
- Proration: No proration for partial months
- Processing Errors: Full refund for any billing errors we make
Note: Subscription fees cover access to our platform and payment automation services. They do not include the actual mortgage payment amounts, which are separate charges to your bank account.
Cancellation
You may cancel your subscription at any time:
- Cancel through your account settings or contact support
- Cancellation takes effect at the end of your current billing period
- You will retain access until the end of the paid period
- No refunds for the current billing period
- Scheduled mortgage payments will continue until you disable them
Price Changes
We reserve the right to change our pricing:
- We will provide 30 days' notice of any price increases
- Founding member rates will never increase
- You may cancel before the price change takes effect
- Continued use after price change constitutes acceptance

User Responsibilities
Accurate Information
You are responsible for:
- Providing accurate mortgage information (balance, rate, payment amount)
- Verifying your lender accepts bi-weekly payments
- Ensuring sufficient funds are available for scheduled payments
- Updating your information when your mortgage changes
- Reviewing payment confirmations and account statements
Bank Account Management
You must:
- Maintain adequate funds for both subscription fees and mortgage payments
- Notify us immediately if your bank account is closed or changed
- Monitor your bank statements for Jubilee transactions
- Report any unauthorized transactions within 60 days
Lender Communication
You remain responsible for:
- All communications with your mortgage lender
- Verifying your lender has received and applied payments
- Resolving any payment application issues with your lender
- Understanding your mortgage terms and conditions
- Maintaining your relationship with your lender
Tax and Legal Obligations
You are solely responsible for:
- All tax implications of using bi-weekly payments
- Consulting with tax professionals regarding mortgage interest deductions
- Compliance with all applicable laws and regulations
- Understanding how bi-weekly payments affect your financial situation
Critical: Jubilee does not provide financial, tax, or legal advice. Always consult with qualified professionals regarding your specific situation.
Security Obligations
You agree to:
- Keep your login credentials secure and confidential
- Not share your account with others
- Use secure internet connections when accessing your account
- Report suspected security breaches immediately
- Log out after each session on shared devices

Prohibited Conduct
You agree NOT to:
Fraudulent Activity
- Provide false or misleading information
- Impersonate any person or entity
- Use another person's account without permission
- Engage in any fraudulent payment activity
- Attempt to manipulate our pricing or billing systems
System Abuse
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt our services
- Use automated scripts, bots, or scrapers
- Reverse engineer or decompile our software
- Introduce viruses, malware, or harmful code
Intellectual Property Violations
- Copy, modify, or distribute our content without permission
- Remove copyright or trademark notices
- Use our trademarks or branding without authorization
- Create derivative works based on our service
Prohibited Purposes
- Use the service for any illegal purpose
- Violate any local, state, national, or international law
- Money laundering or terrorist financing
- Processing payments you are not authorized to make
- Any purpose that harms Jubilee or its users
Commercial Use
- Resell or redistribute our services
- Use our service for commercial purposes without written permission
- Create competing services using our platform
- Access our API without authorization
Consequences: Violation of these terms may result in immediate account termination, legal action, and reporting to law enforcement authorities.

Intellectual Property Rights
Our Intellectual Property
All content, features, and functionality of Jubilee are owned by us and protected by copyright, trademark, and other intellectual property laws. This includes:
- Software, code, and algorithms (including our Interest Cascade algorithm)
- Website design, graphics, and user interface
- Text, images, videos, and other content
- Logos, trademarks, and service marks
- Business methods and processes
Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use our service for personal, non-commercial purposes
- View and print content for your personal records
- Use our service in accordance with these Terms
This license does not include the right to:
- Modify, copy, or distribute our content or software
- Create derivative works or compilations
- Use our content for commercial purposes
- Remove any copyright or proprietary notices
Your Content
You retain ownership of any information or data you provide to Jubilee. By using our service, you grant us a license to:

Feedback

The Jubilee name, logo, and all related trademarks are our property. You may not:

- Create domain names or social media accounts using our trademarks

Copyright Infringement

Jubilee does not provide financial, investment, tax, or legal advice. We are a payment facilitation service only. You acknowledge that:
- Our savings calculations are estimates based on your input
- Actual savings depend on your lender's terms and payment application
- We do not guarantee any specific financial outcomes
- You should consult qualified professionals for financial advice
- Past performance or estimates do not guarantee future results
Third-Party Services
We use third-party services (Plaid, Stripe, Melio) to process payments. We disclaim all warranties regarding:
- Availability and reliability of third-party services
- Security of third-party systems
- Errors or delays caused by third parties
- Content or practices of third-party websites
Lender Relationships
We are not affiliated with any mortgage lenders. We do not:
- Control how lenders apply or process payments
- Guarantee lenders will accept bi-weekly payments
- Represent or warranty lender practices or policies
- Have any relationship with your specific lender
Important: Some jurisdictions do not allow disclaimers of implied warranties. In such jurisdictions, the above disclaimers may not apply to you. You may have additional rights under your local laws.
Accuracy of Information
While we strive for accuracy, we do not warrant that:
- Calculations are free from errors
- Information is complete or current
- Material on our website is appropriate for your situation
- Your specific results will match our estimates

Limitation of Liability
General Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUBILEE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR USE
- LOSS OF OR DAMAGE TO PROPERTY
- PERSONAL INJURY OR EMOTIONAL DISTRESS
- ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE OUR SERVICE
Maximum Liability Cap
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF JUBILEE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.
Specific Limitations
We are not liable for damages arising from:
- Payment processing delays or errors by banks or payment processors
- Your lender's refusal to accept or application of payments
- Inaccurate information you provide
- Your failure to maintain sufficient funds
- Unauthorized access to your account due to your negligence
- Third-party services or content
- Force majeure events beyond our control
- Your violation of these Terms
Payment-Related Liability
We are not responsible for:
- Late fees charged by your lender due to payment timing
- Credit score impacts from payment timing or amounts
- Penalties from your lender for payment structure changes
- Tax consequences of bi-weekly payment arrangements
- Lost savings if payments are not applied as expected
Note: Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, our liability may be limited to the maximum extent permitted by law.
Basis of the Bargain
You acknowledge that we have set our prices and entered into these Terms in reliance upon these limitations of liability. These limitations are an essential element of the agreement between us.

Indemnification
Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless Jubilee, its officers, directors, employees, agents, affiliates, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:
- Your use or misuse of our service
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any rights of another person or entity
- Inaccurate information you provide
- Your relationship with your mortgage lender
- Payment disputes with your lender or bank
- Any content you submit or share through our service
Defense and Settlement
We reserve the right to:
- Assume exclusive defense and control of any matter subject to indemnification
- Require your cooperation in defending such claims
- Reject any settlement that includes admission of liability or wrongdoing
Notification
We will notify you promptly of any claim for which we seek indemnification. Your indemnification obligations survive termination of these Terms and your use of our service.

Termination
Your Right to Terminate
You may terminate your account at any time by:
- Canceling through your account settings
- Contacting customer support
- Emailing support@jubilee.app
Upon termination:
- You will lose access at the end of your current billing period
- No refund will be provided for the current period
- All scheduled payments will be canceled
- Your data will be deleted according to our Privacy Policy
Our Right to Terminate
We may suspend or terminate your account immediately, without notice, if:
- You violate these Terms
- Your payment method fails repeatedly
- We detect fraudulent or illegal activity
- We are required to do so by law
- You engage in conduct harmful to Jubilee or other users
- Your account remains inactive for an extended period
- We decide to discontinue the service
Effect of Termination
Upon termination by either party:
- All licenses granted to you will immediately cease
- You must stop using our service
- Outstanding fees remain due and payable
- Sections regarding disclaimers, limitations, and dispute resolution survive
Data After Termination
After account termination:
- We may retain certain data as required by law
- We may retain anonymized, aggregated data indefinitely
- Personal data will be handled according to our Privacy Policy
- You may request a copy of your data before deletion
Service Discontinuation
We reserve the right to discontinue Jubilee at any time. If we do:
- We will provide 30 days' notice when possible
- We will refund prorated subscription fees
- We will provide instructions for accessing your data
- We are not liable for any damages from discontinuation

Dispute Resolution and Arbitration
Please Read Carefully: This section includes an arbitration agreement and class action waiver that affect your legal rights. You are agreeing to resolve disputes through binding arbitration instead of court proceedings.
Informal Resolution
Before filing a claim, you agree to:
- Contact us at legal@jubilee.app to describe the dispute
- Provide your name, account information, and desired resolution
- Allow 60 days for us to attempt to resolve the dispute informally
Binding Arbitration
If informal resolution fails, you agree that:
- Any dispute will be resolved through binding arbitration
- Arbitration will be conducted by the American Arbitration Association (AAA)
- AAA's Consumer Arbitration Rules will apply
- Arbitration will be conducted via telephone, online, or written submissions
- If in-person hearing is required, it will be in Louisville, Kentucky
Arbitration Costs
For claims under $10,000:
- We will pay all arbitration fees
- Each party pays their own attorneys' fees unless AAA rules provide otherwise
Class Action Waiver
YOU AGREE THAT:
- DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY
- YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS
- YOU WAIVE THE RIGHT TO CLASS ARBITRATIONS
- YOU WAIVE THE RIGHT TO REPRESENTATIVE ACTIONS
- ARBITRATOR CANNOT CONSOLIDATE MULTIPLE CLAIMS
Exceptions to Arbitration
Either party may bring claims in small claims court if they qualify. Additionally, either party may seek injunctive relief in court for:
- Intellectual property infringement
- Unauthorized access to systems
- Violations of our intellectual property rights
Opt-Out Right
You have the right to opt out of this arbitration agreement by:
- Sending written notice to legal@jubilee.app
- Within 30 days of accepting these Terms
- Including your name, address, email, and statement opting out
Governing Law
These Terms are governed by the laws of the State of Kentucky and the United States, without regard to conflict of law provisions.

- Update our technology and infrastructure

Entire Agreement
These Terms, together with our Privacy Policy and any additional terms you agree to, constitute the entire agreement between you and Jubilee and supersede all prior agreements or understandings.
Severability
If any provision of these Terms is found to be unenforceable or invalid:
- That provision will be limited or eliminated to the minimum extent necessary
- The remaining provisions will remain in full force and effect
- The invalid provision will be replaced with a valid provision that best matches the intent
Waiver
Our failure to enforce any right or provision in these Terms does not constitute a waiver of:

- Our right to enforce it in the future
- Any other terms or provisions
Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms:
- To any affiliate or subsidiary
- In connection with a merger, acquisition, or sale of assets
- To any successor in interest
Force Majeure
We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including:
- Acts of God, natural disasters, or severe weather
- War, terrorism, or civil unrest
- Government actions or restrictions
- Pandemics or public health emergencies
- Internet or telecommunications failures
- Bank or payment processor outages
Relationship of Parties
Nothing in these Terms creates a:
- Partnership, joint venture, or employment relationship
- Agency or fiduciary relationship
- Franchise relationship
Third-Party Beneficiaries
These Terms do not confer any third-party beneficiary rights. Only you and Jubilee may enforce these Terms.
